These Terms and Conditions (“Terms” or “Agreement”) govern access to and use of gapspecialists.com and any website content, inquiry forms, communications, information, or online features provided by GAP Specialists LLC (“GAP Specialists,” “we,” “us,” or “our”).
By accessing the website, submitting an inquiry, selecting an acceptance checkbox, electronically signing a document, or otherwise using the website, you acknowledge that you have read, understood, and agreed to these Terms and the GAP Specialists Privacy Policy.
If you do not agree to these Terms, do not use the website or submit information through it.
GAP Specialists LLC is a Louisiana licensed and insured private investigative agency operating under Louisiana Agency License No. 10138-080322-LA.
- PURPOSE OF THE WEBSITE
The website provides general information about GAP Specialists and its investigative, digital-forensics, process-service, intelligence, consulting, and related services.
Website content is provided for general informational and business-inquiry purposes only. Nothing on the website constitutes:
• Legal advice or a legal opinion.
• Financial, medical, safety, or emergency advice.
• A guarantee that GAP Specialists will accept a matter.
• A guarantee that a particular service is legally or practically available.
• A promise or guarantee of a particular investigative result.
• The creation of an investigator-client relationship.
• The creation of an attorney-client relationship or legal privilege.
A person should consult a licensed attorney regarding legal rights, court deadlines, evidence, litigation strategy, admissibility, or interpretation of the law.
- ELIGIBILITY AND AGE REQUIREMENTS
A person must be at least eighteen (18) years old and legally capable of entering into a binding agreement to retain GAP Specialists or independently submit a case inquiry.
A person under eighteen may not retain GAP Specialists or submit an inquiry without the involvement and authorization of a parent, legal guardian, attorney, or other legally authorized adult.
By using the website or submitting information, you represent that:
• You are at least eighteen years old or are acting with proper legal authorization.
• The information you submit is truthful and accurate to the best of your knowledge.
• You have lawful authority to provide the information.
• Your request is being made for a lawful and legitimate purpose.
- NO INVESTIGATOR-CLIENT RELATIONSHIP FROM WEBSITE USE
Accessing the website, submitting a contact form, sending an email, leaving a voicemail, participating in an initial consultation, or discussing a potential matter does not automatically establish an investigator-client relationship.
An engagement begins only after:
• GAP Specialists completes any necessary conflict, legality, scope, safety, and risk review.
• GAP Specialists agrees to accept the matter.
• The required written investigative agreement is completed and signed.
• Any legally required witnesses execute the agreement.
• The required retainer or advance payment is received and cleared.
• Any required identification, authorization, consent, or intake documentation is provided.
GAP Specialists may decline any proposed engagement, subject to applicable law, without being required to disclose confidential business considerations, conflicts, security concerns, investigative limitations, or other internal reasons for the decision.
- SEPARATE INVESTIGATIVE AGREEMENT REQUIRED
Paid investigative services for a private client will be governed by a separate written client agreement identifying the parties, purpose and scope of the investigation, fees and expenses, client responsibilities, agency responsibilities, limitations, signatures, witnesses, and any other legally required terms.
These website Terms do not replace the required signed client agreement.
If these Terms conflict with a signed client agreement, the signed client agreement controls concerning the paid services covered by that agreement. These Terms continue to govern website use and any matter not addressed by the signed client agreement.
- LAWFUL PURPOSE AND CLIENT AUTHORITY
GAP Specialists performs only services it reasonably believes may be conducted lawfully, safely, and ethically.
A client or prospective client must provide complete and accurate information concerning:
• The purpose of the requested investigation.
• The client’s relationship to the people, property, accounts, records, devices, businesses, or matters involved.
• Any pending lawsuit, criminal proceeding, custody case, protective order, restraining order, court order, probation condition, or legal restriction.
• Any known or possible conflict of interest.
• Any hearing date, trial date, filing deadline, prescriptive period, or other time-sensitive requirement.
• Any prior investigation, surveillance, confrontation, communication, attempted access, or related activity.
GAP Specialists may require proof of identity, ownership, custody, consent, representation, authorization, or other lawful authority before accepting or continuing an assignment.
- PROHIBITED REQUESTS AND CONDUCT
A person may not use the website or request GAP Specialists’ assistance to:
• Commit, assist, encourage, conceal, or prepare for a crime, fraud, tort, or unlawful act.
• Stalk, harass, intimidate, threaten, extort, retaliate against, or unlawfully discriminate against another person.
• Violate a protective order, restraining order, custody order, court order, probation condition, or other legal restriction.
• Gain unauthorized access to a telephone, computer, email account, social-media account, cloud account, financial account, electronic device, vehicle, residence, private property, or protected record.
• Install or request unlawful tracking, interception, surveillance, recording, spyware, hacking, malware, or monitoring technology.
• Impersonate another person or falsely claim legal authority.
• Obtain information through identity theft, false pretenses, unlawful pretexting, or prohibited misrepresentation.
• Interfere with witnesses, destroy or alter evidence, conceal evidence, obstruct justice, or interfere with a legal proceeding.
• Locate a person for an unlawful, abusive, threatening, or unauthorized purpose.
• Conduct an unlawful employment, housing, credit, insurance, or consumer-report background check.
• Ask GAP Specialists to misrepresent itself as law enforcement, a government agency, an attorney, or another regulated professional.
• Use investigative information to harass, threaten, intimidate, publicly shame, retaliate against, or unlawfully harm another person.
GAP Specialists may refuse, suspend, or terminate a matter if it reasonably believes a request or client’s conduct is unlawful, dishonest, unsafe, unethical, outside the agreed scope, or inconsistent with professional obligations.
- CLIENT RESPONSIBILITIES
A client is responsible for:
• Providing truthful, accurate, complete, and timely information.
• Disclosing all material facts and known legal restrictions.
• Providing requested documents, photographs, records, court filings, and contact information.
• Promptly notifying GAP Specialists of changed circumstances.
• Avoiding interference with surveillance, interviews, process service, evidence collection, or other investigative activity.
• Refraining from confronting an investigative subject based on active case information unless advised by the client’s attorney or otherwise appropriate.
• Preserving original evidence, electronic files, messages, devices, and documents.
• Paying retainers, professional fees, expenses, and invoices when due.
• Consulting an attorney regarding legal strategy, court deadlines, admissibility, and litigation requirements.
GAP Specialists is not responsible for consequences caused by inaccurate, incomplete, misleading, withheld, altered, or untimely information supplied by a client or another source.
- PROFESSIONAL AND RESPECTFUL CONDUCT
Clients, prospective clients, authorized representatives, and other persons communicating with GAP Specialists must behave professionally and respectfully.
GAP Specialists will not tolerate:
• Threatening, intimidating, aggressive, or abusive behavior.
• Harassment, stalking, repeated unwanted contact, or retaliation.
• Yelling, excessive profanity, insults, personal attacks, or degrading language.
• Sexual comments, sexual harassment, or inappropriate conduct.
• Discrimination based on race, color, religion, sex, national origin, age, disability, or any other legally protected status.
• Threats against GAP Specialists, its investigators, employees, contractors, clients, witnesses, investigative subjects, or other persons.
• Knowingly false accusations, fraudulent chargebacks, impersonation, or attempts to harm the company through knowingly false statements.
• Interference with surveillance, process service, interviews, digital analysis, evidence collection, or other investigative activity.
• Demands that GAP Specialists perform unlawful, unethical, unsafe, dishonest, or unauthorized acts.
GAP Specialists may refuse service, restrict communications, require communications to be made in writing, suspend work, withdraw from an assignment, or immediately terminate an engagement when a person’s conduct is abusive, threatening, harassing, discriminatory, dishonest, unsafe, excessively disruptive, or otherwise unprofessional.
If an engagement is terminated because of the client’s conduct, the client remains responsible for all earned professional fees, incurred expenses, noncancelable commitments, work required to safely close and preserve the file, and any other amount properly due under the signed agreement.
- SCOPE AND LIMITATIONS OF INVESTIGATIVE SERVICES
The scope of each paid investigation will be established in the signed client agreement.
GAP Specialists may determine the lawful methods, timing, staffing, equipment, databases, routes, observation locations, research methods, and operational decisions reasonably appropriate to the engagement.
An investigation may be affected or limited by:
• Applicable laws and professional rules.
• Weather, traffic, geography, safety, visibility, and access restrictions.
• Private-property rights and restrictions.
• A subject’s conduct, schedule, location, awareness, travel, or security measures.
• Incomplete, inaccurate, outdated, sealed, restricted, deleted, encrypted, inaccessible, or unavailable information.
• Database limitations, public-record delays, court schedules, and third-party response times.
• Equipment, communication, internet, software, or other technology limitations.
• Budget, available retainer, client instructions, staffing, time limits, and the agreed scope.
GAP Specialists may recommend changes to the scope, budget, schedule, or investigative plan when reasonably necessary.
- NO GUARANTEE OF RESULTS
Investigations involve uncertain facts, human behavior, third-party records, technology, access limitations, and circumstances beyond the control of GAP Specialists.
GAP Specialists does not guarantee:
• That surveillance will document any particular conduct.
• That a person will be located.
• That process service will be successfully completed by a particular date.
• That records or evidence exist or can be obtained.
• That deleted, damaged, encrypted, or inaccessible digital information can be recovered.
• That a witness will cooperate, provide information, or testify.
• That public records, licensed databases, social media, or third-party information will be complete, current, or error-free.
• That evidence will be admitted or accepted by a court, attorney, insurer, employer, or government agency.
• That a client will win a lawsuit, custody matter, criminal case, insurance claim, employment matter, or other dispute.
• That an investigation will be completed within an estimated number of hours or by an estimated date.
GAP Specialists agrees to provide professional services with reasonable diligence and care. GAP Specialists does not manufacture evidence, guarantee an outcome, or promise to discover facts that do not exist.
- BACKGROUND CHECKS AND CONSUMER REPORTS
Certain background checks and reports may be governed by the federal Fair Credit Reporting Act and other federal or state laws.
A client requesting information for employment, housing, credit, insurance, or another legally regulated purpose must:
• Disclose the true purpose of the request.
• Possess a lawful permissible purpose.
• Obtain required written consent or authorization.
• Provide legally required notices.
• Follow applicable adverse-action procedures.
• Refrain from using information for unlawful discrimination, harassment, retaliation, or another prohibited purpose.
GAP Specialists may refuse a background-check request when lawful authority or permissible purpose is not adequately established.
- DIGITAL FORENSICS AND ELECTRONIC DEVICES
A person requesting digital-forensics or electronic-device services must establish lawful ownership, possession, consent, custody, or other authority.
